Minutes of Town of Mineral Council Meeting
7:00 p.m.
March 12, 2007


Roll Call

PRESENT:Council Member Brooks Besley, Roy McGeHee, Council Member Roy Payne. William Thomas and Bernice Wilson-Kube; Mayor Edwin Keller.
ABSENT:Vice-Mayor Pam Harlowe;
STAFF:Treasurer/Clerk Ti-Lea Downing; Town Manager Willie Harper; Town Attorney Jack Maus.
PUBLIC:Tammy Ware, Janice Abercrombie, Ed Kube, Ed Jarvis, and Jacylin O'Laughlin with the Central Virginian.

Invocation was given by Roy Payne.

Public Comments
Ed Jarvis said he was pleased with the reassessments of the Town property and wanted to thank the Council if they had anything to do with the reassessments.

Adopt Agenda (add or take away items at this time)
Roy Payne made a motion to adopt agenda. Brooks Besley seconded the motion. Motion passed 5/0 with None voting in the negative.

Approval of February regular meeting minutes
William Thomas made a motion to approve February minutes. Roy McGeHee seconded the motion. Motion passed 5/0 with None voting in the negative.

Approval of March 2007 bills to be paid
Mrs. Wilson-Kube asked that the Jarvis attorney bills be separated for vote. Roy Payne made a motion to accept the March bills to be paid without the attorney bills pertaining to the Jarvis matter included William Thomas seconded the motion, Motion passed 5/0 with None voting in the negative.

William Thomas made a motion to pay attorney bills pertaining to Jarvis matter Roy Payne seconded the motion. Motion passed 4/1 with Bernice Wilson-Kube voting in the negative.

Town manager's report

Mrs. Wilson-Kube asked if the Town Manager could check into possibilities of routing the water away from Mrs. Thruston's yard. When the tank overfills, the water runs into Mrs. Thruston's yard. The Town Manager stated that he would get the engineer to look at this situation and come up with a possible solution.

Town Attorney's report

Standing Committee Reports:

Beautification / Anti-Litter Committee: There was not a meeting this month due to the weather. The committee will meet in the month of March to discuss possible plantings around town and banners.

Budget & Finance Committee: William Thomas would like to see the retirement plan put in the budget. The budgeted amount would not be for prior year's service just for employment only.

Cemetery Committee: Mr. Besley has looked at the sign and the dimension; he was concerned about the size being too large. Mr. Besley went to the cemetery with a frame to get an idea of the actual size of the sign. He does not feel that the sign would be too large. Roy Payne made a motion to replace the sign at the cemetery in the amount of $9000.00 to be taken from the cemetery fund, William Thomas seconded the motion. Motion passed 5/0 with None voting in the negative.

Economic Development Committee: No Report

Personnel Committee: No Report

Police & Legal Matters Committee: Mr. Thomas asked if there was a need for police service in the Town of Mineral. Mr. McGehee stated there is not a need for police presence in the Town. There could be a possible need for police presence for different traffic situations. In general there is not a need for police presence to be designated to the Town of Mineral.

Streets Committee:Mr. Besley will work with the Town Manager on clarification on the street ordinance pertaining to private roads. VDOT cleared some of the debris around 7th Street.

Walton Park Committee: There is possible tree work that needs to be done. Some of the firemen were not happy with the suggestion of the removal of the barn. The Mayor asked that the Town Manager speak with members of the fire department and discuss this situation.

Water & Sewer Committee: No report

Old Business:

A. Confirm Public Hearing Satian's proposed project
The public hearing will be on March 28, 2007 at 7:00 p.m. at the Church of Incarnation. At 6:00 p.m. the developer, enginners, town staff, and Council members will be present to give public a chance to view the maps and ask questions before the public hearing.

B. Mineral Elementary School - Debris outside of school - The Town Attorney had written a letter to Mr. Morgan asking for the debris to be removed, the repair of a fence, and payment to the Town for the removal of the auditorium. Mr. Morgan did respond to the letter, only to the matter of the cost of the Town removal of the auditorium. The Town Attorney was asked to contact Mr. Morgan again and advise him that the Town will take action if he does not.

C. Meeting with Town of Louisa proposed dates April 23 or 24 The Council decided that they would meet with the Town of Louisa on Tuesday April 24th at the Town of Louisa Hall at 7:00 p.m.

D. Cemetery sign- This was discussed at the Cemetery standing committee.

E. Angle Parking - Railroad Avenue - Tammy Ware owner of Total Body Fitness- Ms. Ware with Total Body Fitness is requesting that the parking near the Express Lane be done as angle parking to provide additional parking to patriots of her establishment. The Town Manager gave a brief description of the situation. Ms. Ware's clients are complaining about the parking. She would hate for her to leave because of the lack of parking. Bernice Wilson-Kube made a motion to have the Town Manager look into the situation of the parking, possibly contacting VDOT and or the railroad, William Thomas seconded the motion. Motion passed 4/1 with Roy Payne voting in the negative.

William Thomas made a motion to go into closed session pursuant to VA code 2.2.-37 11 A1 & 2.2.-37 11 A7 seconded by Roy Payne. Motion passed 5/0 with None voting in the negative.
