Minutes of Town of Mineral Council Meeting
7:00 p.m.
October 10, 2006
Present: Edwin Keller, Mayor, Pam Harlowe, Vice-Mayor, Brooks Besley, Roy Payne, Bernice Wilson-Kube, Jack Maus, Town Attorney, Willie Harper, Town Manager and Ti-Lea Downing, Town Clerk.
Absent: Roy McGehee and William Thomas
Also present: Ed Kube, Edwin Jarvis, Representativies of Central Virginia Technologies Group LLC, Representatives of Virginia Broadband, Jimmie Dodd, Hank Staudinger and Irene Luck with The Central Virginian.
Presentation of use of water tower by Central Virginia Technology Group & Virginia Broadband. These groups came before Council to review their proposals for the use of the Town's water tower. Discussion followed. Motion made by Roy Payne to enter into a contract with Central Virginia Technology Group LLC to provide internet services to the citizens of the Town of Mineral, motion died without a second. Motion made by Bernice Wilson-Kube to accept Virginia Broadband proposal for use of the Town's water tower, the lease for five years with the option to exist either side for six months, seconded by Pam Harlowe. Motion passed 3-1 with Roy Payne abstaining.
Public Comments:
Ed Jarvis asked if the Council had decided that there were not hazardous materials at the old Mineral Elementary School, since some of the bids stated the Council would have to deal with the disposal of the materials.
Mr. Harper answered that there are no hazardous materials at the site. As owner had mitigated the asbestos issue and we are not disturbing the subsurface other than the footer.
Hank Staudinger wanted to inform all that the concrete and masonry will be broken up six inches or smaller, so the landfill will not charge the Town. Their bid may be higher due to this work, but the cost offset, as there will be no charge for the masonry at the landfill.
Mr. Jarvis stated that he had been told that certain persons of the Town Council had told persons that Mr. Jarvis is suing the Town. Mr. Jarvis feels that the Town Council should state that they are suing Mr. Jarvis.

Legal matters
Discussion of September 11 & September 19 minutes. Motion made to approve September 11 & 19 meeting minutes with the deletion of amended (verbatim) items, by Roy Payne, seconded by Pam Harlowe. Motion passed 3-2. With Edwin Keller, Pam Harlowe, and Roy Payne voting for. Brooks Besley and Bernice Wilson-Kube voting against.
Mrs. Wilson-Kube requested that the October bills have the attorney bills pulled for a separate vote.
Discussion of October 2006 bills. Motion to approve payment of October 2006 bills without the attorney bill included, by Pam Harlowe, seconded by Bernice Wilson-Kube. Motion passed 4-0.
Motion made by Pam Harlowe to pay the attorney bill, Payne & Hodous, seconded by Roy Payne. Motion passed 3-1 with Bernice Wilson-Kube voting against. Mrs. Wilson-Kube stated that she was not on Council when this lawsuit was instigated and she is becoming alarmed at the amount of taxpayer money that is being spent.
Willie Harper presented the Town Council with his manager's report.
Motion made by Roy Payne that the water and sewer committee, Mayor, and Town manager make the decision of the use of the $35,318.71 for equipment, seconded by Pam Harlowe. Motion passed 4-0.
Jack Maus presented the Town Council with his attorney's report.
Committee Reports:
Beautification/Anti-Litter: There was a scheduled cleanup on October 7, 2006 that was postponed to October 8, 2006 due to the rain. The Cemetery sign and trees were weeded. The trash was picked up on Mineral Avenue. The question was raised if Council would consider the use of holiday flags instead of the wreaths. Discussion followed pertaining to the flags and this will be decided at a later date, in time for next year's holidays. The Town Improvement Committee will meet the fourth Tuesday of every month.
Budget & Finance: No Report.
Cemetery Committee: No Report.
Commercial Matters: This will be renamed economic committee.
Personnel report: There will be discussion in closed session pertaining to personnel matters.
Police & Legal Matters: Possibly installing a light in the alley way between the railroad and the Mineral Express Lane. The cost of this light will be obtained for next month's meeting.
Streets: The pole that was struck at First Street and Mineral Avenue will be repaired. If the repairs do not start within two weeks than the electric company will be contacted again.
Walton Park: No Report.
Water & Sewer: No Report.
New Business:
A. VDOT - 6yr- Primary Road System -position - Motion made by Roy Payne to adopt resolution to set a plan between Louisa and Mineral, mainly Mineral Avenue and 1st Street With the 6 year plan, seconded by Brooks Besley. Motion passed 4-0
B. Request for Proposal - Town Engineering-Consultant. Motion made by Roy Payne to advertise and solicit for an Engineering consultant for the Town, seconded by Brooks Besley. Motion passed 4-0.
C. Award contract for removal of old Auditorium Building Mineral School- This will be decided after closed session
Old Business:
Motion made by Roy Payne to go into closed session for the purpose of personnel pursuant to code 2.2-37 11 A1, pending litigation 2.2-37 11 A7, acquisition of real property, 2.2-37 11 A3, and to award contract 2.2-37 11 A30, seconded by Brooks Besley. Motion passed 4-0.

Motion made by Roy Payne to award demolition of Old Auditorium Mineral Building to Central Virginia Contractors with stipulation of possible legal matters pending, that may hold up contract, seconded by Brooks Besley. The amount of the contract $20,866.63.There was a lower bid but they did not submit a completion date. Motion passed 4-0.
Motion made by Brooks Besley to adjourn, seconded by Bernice Wilson-Kube. Motion passed 4-0.
